يهدف هذا البحث لدراسة قاعدة من القواعد المهمة والتي تتعلق تعلقا وثيقا بالسياسة الشرعية فهو يبين معنى هذه القاعدة، وأهميتها، وأصلها، ودليلها، وضوابط إعمالها، ويذکر کثيرا من التطبيقات المعاصرة لها والتي يعالج من خلالها الکثير من المشکلات المعاصرة کالتهرب الضريبي والحجر الصحي زمن انتشار الوباء، وتجريم مخالفات البناء، وإنشاء المؤسسات الإدارية الحديثة لتحقيق المصالح الضرورية، وتولية الوزراء والقضاة والمحافظين وعزلهم...... إلى آخره، ويبين مدى سلطات ولي الأمر، وبيان مدى صحة تصرفاته، وضوابط نفاذ هذه التصرفات. 
This research paper aims to study one of the most important rule closely related to the legal policy. It explores the meaning of this rule, its importance, origin, evidence, and implementation standards. It examines many of its contemporary applications with a view to addressing many contemporary problems such as tax evasion, quarantine during the time of Coronavirus epidemic's spread, criminalization of building violations, establishment of modern administrative institutions to achieve necessary public interests, and the appointment and dismissal of ministers, judges and governors, etc. It defines the extent of the powers assumed by the ruler, the validity of his actions, and the standards of enforcing these actions.
