يدور البحث في مدي الحماية الجنائية التي تکفلها التشريعات القانونية والفقه الإسلامي ويتناول مفهوم الجنين المشوه  وأسباب تشوه الأجنة والتکييف الطبي والفقهي لهذه التشوهات، کما تناول مرکز الجنين المشوه، ومدي الحماية المکفولة له سواء قبل اکتشاف التشوهات أو بعد اکتشافها بإمکانية علاج هذه التشوهات، ثم متى يجوز إجهاض الجنين المشوه.
 
This research paper deals with the degree of criminal protection guaranteed by legal legislations and Islamic jurisprudence.  It deals with the concept of a malformed fetus and the causes of fetal malformation and medical and juristic conditioning of these abnormalities. It also presents the position of a malformed fetus, and the degree of protection it enjoys, whether before the discovery of these malformations or after their discovery and the possibility of treating them. It also addresses the time when abortion of a malformed fetus is permissible.
