أثر العرف في فهم السنة

تناول البحث موضوع: أثر العرف في فهم السنة، وعرض له من خلال التعريف بالعرف، وحجيته، ثم تناول البحث ضوابط العرف المؤثرة في فهم السنة، وما المجالات التي يُعمل فيها بالعرف في السنة، ثم تطرق البحث لتطبيقاتٍ على مسألة إعمال العرف في قبض المبيع، بصورتيه القديمة والحديثة، وخلص البحث إلى نتائج من أبرزها: أن العرف مؤثرٌ في فهم السنة النبوية، وأن العرف لا يُعمل به في العقائد والأحکام التعبدية، وإنما يُعمل به في السنة التي أحالت للعرف، أو التي وردت بحکم مطلقٍ عن التحديد، أو التقدير.
 
 
This research paper addresses the topic of the effect of the norm on understanding the Sunnah. It begins with the definition of the norm and its authenticity, then it discusses the criteria of the norm that affect understanding the Prophetic Tradition, the areas to which the norm is applicable.  The research also investigates the application of the norm to the issue of receiving a sold item both in its old and modern forms.  The research paper concludes with some results, the most remarkable of which are the following:  The norm has an influential role in understanding the Sunnah of the Prophet (pbuh). The norm is not applicable to articles of faith and devotional tenets. It is only applicable to the Sunnah issues that have been referred to the norm or that have acquired an absolute ruling without restrain or conjecture.
