مقاصد الشريعة في التعامل مع غير المسلمين "دراسة فقهية"

هدف البحث إلى دراسة مقاصد الشريعة في التعامل مع غير المسلمين دراسة فقهية, وتضمنت الدراسة تمهيد ومبحثين, حيث شمل التمهيد التعريف بموضوع البحث, وتناول المبحث الأول: مقاصد الشريعة والضوابط العامة للتعامل مع غير المسلمين, وتناول المبحث الثاني: الأحکام الفقهية المتعلقة بالتعامل مع غير المسلمين, وهدف الباحث إلى بيان مقاصد الشريعة في بعض الأحکام الشرعية في التعامل مع غير المسلمين وضوابطها, وکان المنهج المتبع في الدراسة هو المنهج الاستقرائي التحليلي، وتوصلت الدراسة إلى عدد من أهم النتائج, منها: من ضوابط التعامل مع غير المسلمين: معرفة المسلم بدينه والالتزام به, فهم الواقع من خلال منهاج الله, أن يعرف المرحلة التي هو فيها ودوره الشرعي في تلک المرحلة، وکذلک من قواعد التعامل مع غير المسلمين, الوفاء بالعهود والمواثيق وتحريم الغدر والخيانة, وعدم قتل من لا يقاتل منهم کالمرأة والصبي والشيخ الکبير والأجير والعباد في المعابد, وجوب حماية أهل الذمة وحرمة دمائهم وأموالهم, حقهم في ممارسة شعائرهم الدينية.  
The present study tackles the purposes of Sharia in dealing with Non-Muslims in a jurisprudential study. It consists of an introduction that defines the topic of the study, and two sections: The purposes of Sharia and its general precepts in dealing with non-Muslims, the juristic rulings of dealing with non-Muslims. The researcher followed the descriptive analytical approach aiming to clarify the purposes of Sharia regarding some rulings and precepts of dealing with non-Muslims. The study concluded with the following regulations when dealing with non-Muslims: the Muslim’s need to understand and adhere to his religion, the Muslim’s need to comprehend his reality by following the teachings of Allah, The Muslim’s need to realize his legal obligations and roles, The Muslim has to adhere to the Islamic rulings of dealing with non-Muslims, such as fulfillment of the covenants, prohibition of treachery and betrayal, prohibition of killing non-combatant women, the children, elders, clergy, laborers and devoted worshippers, and the obligation of protecting the covenanted non-Muslims and granting them their rights of religious freedom.
