فهذا مستخلص لبحثي: موضوع هذا البحث: "القواعد الفقهية التي ذكرها الإمام النووي في مقدمة كتابه المجموع" وهو يستمد أهميته من كونه يتعلق بالقواعد الفقهية، وبتطبيقاتها، وبالإمام النووي، وقد تناول البحث معنى القواعد الفقهية، والفرق بينها وبين الضوابط الفقهية، وأهميتها، والتعريف بالإمام النووي وكتابه المجموع، ودراسة هذه القواعد الفقهية التي ذكرها الإمام النووي دراسة تأصيلية تحليلية تطبيقية من خلال كتب المذهب الشافعي، وغيره من المذاهب التي عنيت بالقواعد الفقهية وتطبيقاتها، وعني البحث بالجانب التطبيقي لهذه القواعد سواءً تطبيقات قديمة أم معاصرة بحسب الحصول عليها من مظانها، واتضح من البحث أن هذه القواعد لم يتعرض لها الباحثون المعاصرون بشيء من الدراسة والتحليل والتطبيق، إلا في القليل منها، وقد توصلت من خلال هذا البحث إلى عدة نتائج من أهمها: أهمية القواعد الفقهية التي ذكرها النووي في هذه المقدمة، حيث تدل على علو كعبه - رحمه الله - في علم الفروع عامة، وفي المذهب خاصة، أهمية هذه القواعد من حيث كثرة الفروع المخرجة عليها.
This research derives its importance from the fact that it is related to jurisprudence rules and their applications and to Imam Al-Nawawi. The research deals with the meaning of jurisprudence rules, the difference between them and jurisprudence controls, and their importance. The paper also introduces Imam Al-Nawawi and his book Al-Majmūˁ, and conducts an applied analytical study of the jurisprudential rules mentioned by him, in light of the books of the Shāfiʿī school, and other schools concerned with jurisprudence rules and their applications. The research focuses on the applied aspect of these rules, whether the applications are ancient or contemporary. The research has proved that contemporary researchers have not conducted any applied or analytical studies on these rules – except for a few of them. The research has revealed some important results, the most important of which are: The importance of the jurisprudential rules mentioned by Al-Nawawi in this introduction, as they testify to his great knowledge of secondary issues in general and of the doctrine in particular. These rules are important since a large number of secondary issues are based on them.
