سفر الزوج بين الإطلاق والتقييد دراسة فقهية مقارنة بقانون الأحوال الشخصية المصري

تهدف الدراسة إلى التعرف على الأحكام المتعلقة بسفر الزوج، والتي من شأنها أن تساعد في معرفة مدى حق الزوج في السفر دون إذن زوجته، أو بقائه مدة طويلة مسافرًا عنها دون موافقتها، وكذا مدى حقه في السفر بها دون رضاها، مع عدم رغبتها في عدم السفر معه، وقد اشتمل البحث على مقدمة، وتمهيد، وثلاثة مباحث، فالتمهيد: في التعريف بالسفر والمقصد الشرعي منه، والمبحث الأول: في حرية سفر الزوج مدة طويلة دون إذن زوجته ونطاق هذا الحق، والمبحث الثاني: في منع الزوج من السفر لحق نفقة الزوجة، والمبحث الثالث: في منع الزوج من السفر بزوجته، وقد خلص البحث إلى: أن الأصل هو حرية سفر الزوج، وأنه يجوز له أن يسافر حيث يشاء دون إذن زوجته، كما أنه يجوز له أن يسافر بها متى شاء رغمًا عنها؛ لكن هذا الحق مقيد بقيود منها: إذا تضررت من جراء ذلك، أو إذا تركها بدون نفقة مدة سفره، وكذلك لا يجوز للزوج السفر بزوجته إذا لم يكن مأمونًا عليها، أو كانت الزوجة اشترطت عدم السفر معه، أو كان قاصداً من سفرها معه الإضرار بها.
The study aims to identify the provisions related to the husband's travel away from his wife, which would help in knowing the extent of the husband's right to travel and staying abroad without his wife's permission or consent. The research contains a preamble, an introduction and three sections. The introduction addresses travel and its legitimate purposes. Then, the first section discusses the freedom of the husband to travel for a long period without his wife’s permission and the extent of this right, while the second tackles preventing the husband from travel under the wife’s right for alimony. Next, it investigates the issue of preventing the husband from traveling with his wife. That paper then concludes that the default case is that the husband is absolutely free to travel without his wife’s permission and even against her will. However, this right is governed by certain restrictions, including that case when his travel causes harm to the wife or when he leaves her no alimony for the duration of his travel. Likewise, the husband may not travel with his wife if he is not trustworthy enough, or if the wife had stipulated in the marriage contract that she would not travel with him, or if he intended through the travel to harm her.
