أثر المقاصد الشرعية في تربية النشء" مقاصد العبادات والمعاملات والآداب أنموذجًا"

اشتمل هذا البحث على مقدمةٍ، وثلاثة مباحث وخاتمة، فالمبحث الأول منها لبيان المقاصد الشرعية وضابطها في الشريعة الإسلامية، ومفهوم تربية النشء، وأساليب التربية، وفي الثاني: تناولت فوائد معرفة المقاصد، وأقسامها، وفي الثالث بينت أثر المقاصد الشرعية في تربية النشء وتطبيقها على العبادات والمعاملات والآداب، ثم كانت خاتمة البحث في أهم النتائج والتوصيات، والتي بينت فيها مفهوم الاصطلاح الأصولي للمقاصد الشرعية، وأنَّ التنوع في تقسيم المقاصد يعود إلى تنوع تعريف العلماء للمقاصد، وأنَّ المعاملات المالية تُعدُّ من الضروريات الخمس للأفراد والمجتمعات، كما أنَّ اعتبار مقاصد المتعاقدين في المعاملات هو الذي يناسب أصول الشريعة وقواعدها الكلية، وأنَّ من أهم المقاصد الشرعية التي أجازت الشريعة لأجلها للنشء التعامل في الأموال الخاصة به هي: حسم مادة الضرر بالمتصرِّف وهو النشء، والإضرار بالغير، وأنه لا بد من الاهتمام بذكر نماذج من الفتاوى المقاصدية لطلاب العلوم الشرعية، خصوصًا فتاوى المجتهدين، لتنمية الملكة المقاصدية عندهم، بتشجيع وتوجيه وإرشاد طلاب الدراسات العليا لاختيار موضوعات تتعلق بالمقاصد الشرعية وأثرها في المجتمع، ونشرها في وسائل الإعلام والمجلات المحكَّمة.
 
This research includes an introduction, three sections, and a conclusion. The first section clarifies the legal objectives and their regulations in Islamic Sharia, the concept of raising young people, and the methods of upbringing. The second section the deals with the benefits of knowing the objectives and their types, while the third addresses transactions and etiquette. Finally, the conclusion summarizes key findings and recommendations. This includes the fundamental roots of legal objectives, and their diversified types based on the difference among scholars in defining the objectives. I also noted that financial transactions are among five collective necessities for individuals and societies, and that the purposes of the contractual parties in transactions falls within the fundamentals of the Sharia and its collective rules. I then highlighted that one of the most important Sharia objectives behind permitting the youth to engage in financial transactions to lift reciprocal harm to or by them. There is also a need to mention examples to objective-based fatwas for students of Sharia sciences, especially the fatwas of the Mujtahids, to develop their objective-based reasoning. We should also encourage and guid postgraduate students to choose topics related to legal objectives and their impact on society, and to publish their research in the media and in peer-reviewed journals.
