المستخلص

تناول الباحث في هذه المقالة نبذة مختصرة عن طبيعة الوقف في ليبيا، وبيان مساهماته الدينية والاجتماعية والاقتصادية والصحية عبر عصوره المختلفة، وبين أهمية الإدارة الوقفية في حفظ أموال الوقف وتنميتها تنمية مستدامة؛ مما ينبغي عليها تفعيل هيئة المراقبة وديوان المحاسبة لمحاربة الفساد الإداري ومعالجة الاختلالات الهيكلية التي تسببتها تغييرات الحكومات منذ عشر سنوات، والتي حالت دون تحقيق مقاصد الوقف وغاياته، اعتمد الباحث على المنهج التاريخي والتحليلي والاستقرائي، خاتماً بأهم النتائج حيث توصل إلى أن الأوقاف الليبية قديماً حققت نجاحات باهرة ومساهمات كبيرة دينية واجتماعية واقتصادية وصحية، والاضطراب السياسي الذي تعيشه ليبيا سبب مشكلات إدارية وقانونية؛ مما أثرت سلباً على أداء إدارة الأوقاف في محاربة الفساد الذي تعيشه الأوقاف، ولم تقم هيئة الأوقاف باتخاذ إجراءات فعليه في معالجة المخالفات والإخفاقات الإدارية، وأخيراً أوصى الباحث بإفراد دراسة تطبيقية خاصة حول تبعات الفساد المالي الذي تعيشه إدارة الأوقاف في ليبيا، مع كشف تلك الإحصاءات على وسائل الإعلام حتى يعرف حجم الفساد ومآلاته على الأوقاف حاضراً ومستقبلاً.
 
This article provides a brief overview of the nature of the endowment in Libya, and its religious, social, economic and health contributions over the different eras. It also discusses the importance of endowment management in preserving endowment funds and developing them in a sustainable way. This requires enforcing the Monitoring Authority and the Audit Bureau to combat administrative corruption and address the structural imbalances caused by the changes of governments ten years ago. This prevented the realization of the endowment’s purposes and objectives. The researcher draws on historical, analytical and inductive approach and concludes the paper with key findings. Among these findings is that the Libyan endowments in the past achieved remarkable successes and great religious, social, economic and health contributions. The researcher points out that the political turmoil in Libya has caused administrative and legal problems that negatively impact the performance of the Endowments Department within. The Endowments Authority did not take genuine action in addressing violations and administrative failures. Finally, the researcher recommends conducting special applied study of the consequences of financial corruption in the Endowments Department in Libya and publishing such statistics in the media, so that the extent of corruption and its repercussions on endowments, present and in the future, are known.
