منهج القرآن في بيان الأحكام الفقهية دراسة استقرائية تحليلية من خلال آيات الأحكام

القرآن الكريم هو عمدة الملة، وأصل الأصول ورأس الأدلة، وهو أعظم مصدرٍ للدلالة على خير الدنيا والآخرة، وقد أنزله الله عز وجل بمنهج فريد في بيانه للأحكام الشرعية عموما، وللأحكام الفقهية على وجه الخصوص، كما أنه منهج متكامل في ألفاظ وأساليبه وتقاسيمه وترتيبه، ولا شك أن لدراسة هذا المنهج أثر بالغٌ وفائدة عظمى، والمقصود من هذا البحث: الكشف عن منهج القرآن في بيان الأحكام الفقهية من خلال استقراء آيات الأحكام، وتكرار النظر في ألفاظها وتراكيبها وسياقاتها ومضامينها وتقسيمها وترتيبها مع مراجعة كلام العلماء من المفسرين والفقهاء وغيرهم حول هذا الموضوع، ومن فوائد هذا البحث: استخراج منهج القرآن في بيان الأحكام الفقهية ليسير عليه الفقيه والمتفقه، وإبراز جانبٍ دقيقٍ من عظمة الكتاب العزيز؛ الذي لا يكتفي بسرد الأحكام الفقهية بل يجمع مع ذلك بلاغة اللفظ وحسن المناسبة والترتيب والتقسيم على وجه يورث اليقين بصدق القرآن وإعجازه، وأنه كلام الحق سبحانه وتعالى، وقد اشتمل البحث على مقدمة وثلاثة مطالب، تناول الباحث في المطلب الأول: منهج القرآن في بيان الأحكام الفقهية من حيث الألفاظ والصيغ، وفي الثاني: منهجه القرآن من حيث أساليب العرض، وفي الثالث: منهجه من حيث التقسيم والترتيب.
 
The Noble Qur’an is the pillar of religion, the core of its principles and the root of its evidence. It is the greatest source of guidance to the good of this world and of the Hereafter. Almighty Allah sent down the Qur’an containing a unique approach in illustrating rulings in general, and juriprudential rulings in particular. It embodies as an integrated approach in terms of its terminology, methods, classifications and arrgangement. There is no doubt that the study of this method has a great impact and is of great benefit. The purpose of the present paper is to highlight the Qur’anic approach in explaining jurisprudential rulings through deductive reading of the verses of rulings, and reconsidering their wording, structuring, contexts, denotations, ordering and arrangement. This also involves a review of the opinions of exegetes, jurists, etc. on this subject. Among the study findings is that the Qur’an adopts a specific methodology in explaining jurisprudential rulings, which jurisprudents and jurisprudence learners can follow. This subtle methodology sustains the greatness of the Glorious Book, which – not only introduces jurisprudential rulings, but does so in an eloquent manner, succinct diction, proper style, and logical arrangement and classification. Hence, it instill certitude through its truthfulness and miraculousness as the Word of Allah, the True God, the Almighty. The research contains an introduction and three sections. First, it discusses the phraseology of respective verses, before investigating their presentational style and then the Qur’anic method of classification and arrangement over verses.
