الأضرار الصحية للموجات الكهرومغناطيسية، الصادرة من أبراج المحمول المخالفة، والواقعة على الجيران - دراسة فقهية Health Damage Caused by Electromagnetic Waves Emanating from Violating Mobile Towers that Affect Neighbors

أدى التطور الكبير والسريع في وسائل تكنولوجيا الاتصالات، إلى الانتشار الواسع لأبراج المحمول داخل المناطق السكنية، رغبة في الاستحواذ والحصول على عدد أكبر من العملاء، وبعض هذه الأبراج المملوكة لشركات الهاتف المحمول قد لا يكون مطابقاً للشروط والمواصفات الفنية للتركيب، مما قد يترتب على ذلك من أضرار صحية تقع على المجاورين لهذه الأبراج، ولما كانت المحافظة على صحة الإنسان مقصداً من مقاصد التشريع الضرورية تندرج تحت مقصد " المحافظة على النفس " كان ولابد من بيان موقف الشريعة إزاء هذه الأضرار، وإبراز العلاقة القوية بين الفقه وواقع المجتمع، وذلك بالتعريف بهذه الموجات الكهرومغناطيسية وأضرارها الصحية، ومفهوم الجار محل الحماية منها وحقه في السلامة البدنية، وصور هذه الموجات والحكم الشرعي لكل صورة حسب أقوال الفقهاء، ومدى حق الشركات المالكة لهذه الأبراج في التصرف في ملكها الخاص وقيود هذا التصرف، والتأصيل الشرعي لحرمة استخدام الموجات الكهرومغناطيسية الضارة، وما يترتب على ذلك من مسئولية مدنية تستوجب التعويض، ومسئولية جنائية عن كافة صور الاعتداء سواء أدى إلى الوفاة، أو الإصابة والتشوهات الجسدية، وأقوال الفقهاء في كل ذلك، وما قررته الشريعة من وسائل وقائية وعلاجية للوقاية من هذه الأضرار، وما توصلت إليه الدراسة من نتائج وتوصيات متعلقة بأهداف البحث والغرض منه، والإجابة على كل تساؤلاته وافتراضياته، مع وضع الحلول الفقهية المناسبة لكل هذه التساؤلات.    
Some of the mobile phone towers may not conform to the terms and technical specifications for installation, which may result in Health damage to the nearby residents. Preserving human life is one of the main goals of Sharia; consequently, preserving human health which is part of human life is also one of the Sharia goals. Therefore, it is necessary to clarify the position of Sharia regarding these harms, and to highlight the strong relationship between jurisprudence and the reality of society. Thus, this research tackles these electromagnetic waves, their harmful effects on health, the concept of protecting the neighbors from them and the residents’ right to physical safety. The research also addresses the companies’ right to dispose of this private property (towers) and the restrictions on this disposal. The research shows the Sharia-based ruling on using harmful electromagnetic waves, their prohibition, the resulting responsibility ensuing from them, the civil liability requiring compensation, and the criminal liability for all forms of harm, whether it leads to death, injury or physical disfigurement. The research touches on the sayings of jurists regarding all of that, the preventive and remedial means prescribed by Sharia to prevent this damage and introduces the appropriate jurisprudential solutions to all these questions.
