يدرس هذا البحث أسلوب التصنيف في كتاب فقهي نحا طريقة معتبرة في عرض المسائل الفقهية من جهة شرحه لأصل معتمد لدى مذهب فقهي أصيل هو المذهب المالكي، وذلك أن المذهب الفقهي يعتمد قول إمامه وما يُخرَّجُ عليه، ثم توضع أصول المذهب بالنظر لذلك، ثم لا تزال تتخرج النوازل والحوادث بناءًا على هذه الأصول؛ ليستمر المذهب على مرّ الزمان ولا ينقطع، ولمَّا كانت أقوال الإمام مالك أكثرُها مجموعةً في المدونة تعلّق بها فقهاء المالكية على ما قد يقع في بعضها من إشكال، أو ضعف فهم للمراد، صنّف ابن يونس كتاب يحلّ فيه كثيرَا من ذلك، ويهدف هذا البحث إلى إبراز قيمة جامع ابن يونس إيضاح نمط دراسته لمسائل المدونة، وإبراز طريقة معالجته للمسائل الفقهية من خلال الوسائل المتبعة لدى الفقهاء في الاستنباط والاستدلال، وجاء البحث في أربعة مباحث، فمبحث في التعريف بالكتاب، وبمنزلته عند المالكية، وبإسهاماته في خدمة المدونة، وبمعالم منهج، وأنتج البحث أهمية معرفة أسلوب التصنيف في فهم الكتاب، كما أنتج بيان تأثير كتاب الجامع في فهم كلام الإمام مالك، واستخلاص الطريقة الفقهية التي تعامل بها ابن يونس مع المسائل الفقهية.
This research examines the method of compiling a jurisprudential book that follows a respected approach in presenting issues of Islamic jurisprudence. It explains the principles upheld by the Maliki School, which relies on the teachings of its Imam and the interpretations derived from them. Since most of Imam Malik's statements are collected in Al-Mudawwana, the Maliki jurists adhered to them in spite of the ambiguities or misunderstandings that might arise from some of these statements. Therefore, Ibn Yunus compiled a book to resolve many of these issues. This research aims to highlight the significance of Ibn Yunus's book, clarify his approach to studying issues in Imam Maik’s Al-Mudawwana, and showcase his method of addressing jurisprudential issues through the means employed by scholars in deduction and reasoning. The research, which falls into four sections, introduces Ibn Yunus’s book, its significance among the Malikis, its contribution to Imam Maik’s Al-Mudawwana, and its methodological features. The research highlights the importance of understanding the compilation style for comprehending the book, outlines the impact of Ibn Yunus’s book on understanding the teachings of Imam Malik, and derives the jurisprudential approach that Ibn Yunus used to handle jurisprudential issues.
