التمويل بالمشارکة من المعاملات المالية التي راج استعمالها من جانب المصارف الإسلامية ،ووجدت لها الکثير من التطبيقات ،المخرجة على کثير من الأحکام الفقهية ،إلا إنها لم تخلو من المقال والاعتراض على بعض صورها ،سيما الشرکات المتناقصة المنتهية بالتمليک؛لذا تنوعت في العمل بها الفتوى ،وتصدت المجامع الفقهية لها ،ومازالت صورها المستجدة توزن بميزان الفقه المنضبط بمقاصد الشريعة الإسلامية الغراء.
ومسألة التمويل بالمشارکة من القضايا الشائکة التي تکتنفها الکثير من الإشکاليات،وخاصة عند من لا يجيزونها ويصفونها بأنها تشبه القرض بفائدة أو بيع الوفاء أو بيوع العينة المنهي عنها شرعاً.
وفي مقابل هذا الرأي وجد من الفقهاء من يجيزها ويسوق الدليل على جواز العمل بها ،بل تصدت لها المجامع الفقهية والندوات والمؤتمرات،وقدمت الحلول المبتکرة والمناسبة لعلاج هذه الإشکاليات ،التي يتصدى لها البحث . 
هذا وقد قسمت بحثي إلى تمهيد ، ومباحث خمسة ،انتهيت منها إلى أسلوب التمويل بالمشارکة مع أهميته إلا أن المخاطر والعقبات التي تحيط به تعيقه عن تحقيق ما يراد منها أن تکون مصدر خصب ونماء من مصادر التمويل التي تجد فيها المصارف الإسلامية ضالتها في توفير التمويل اللازم للقيام بالمشروعات التنموية الرابحة

However, the risks and obstacles that surround it prevent it from achieving what is meant to be a source of wealth and growth from the sources of finance in which the Islamic banks find it necessary to provide the necessary financing for the projects.
