التأويل وأثره في إسقاط الحقوق المتعلقة بالقصاص والحدود والخصومات

تناولنا الحديث في هذا البحث عن التأويل وأثره في اسقاط الحقوق المتعلقة بالقصاص والحدود والخصومات ، وأثره في إباحة الدماء ، حيث قسمنا البحث إلى مبحثين اثنين ، تناولنا في المبحث الأول منه الحديث عن  التأويل ماهيته وضوابطه والعلاقة بينه وبين التفسير ، وقسمنا المبحث إلى ثلاثة مطالب  تناولنا في المطلب الأول بيان ماهية التأويل ، وفي المطلب الثاني الضوابط الواجب توافرها في التأويل ، وفي المطلب الثالث بيان العلاقة بين التأويل والتفسير .
وفي المبحث الثاني تناولنا الحديث فيه عن أثر التأويل في اسقاط الحقوق المتعلقة بالقصاص والحدود والخصومات ، وقسمناه بدوره أيضاً إلى ثلاثة مطالب ، خصصنا المطلب الأول للحديث عن أثر التأويل في إسقاط الحقوق المتعلقة بالقصاص ، وفي الثاني أثر التأويل في إسقاط الحقوق المتعلقة بالحدود ، وأخيراً تناولنا في الثالـث الحديث عن  أثر التأويل في إسقاط الحقوق المتعلقة بالخصومات.
 


Abstract:
In that research we talked about the interpretation and its effect in the overturn of the borders and retribution and also its effect in the allowance of blood. We divided the research into two parts.
In the first part, we talked about the meaning of interpretation, its regulations and the relationship between it and explication. We subdivided that part of the research into three requirements. The first one indicated the meaning of interpretation. The second one clarified the regulations of interpretation. In the third requirement, we showed the difference between interpretation and explication and the relationship between them.
In the second part of the research, we showed the effect of interpretation in the overturn of the rights which are related to borders and retribution. Also we subdivided that part of the research into three requirements. We specified the first one to talk about the effect of interpretation in overturning the rights of retribution. In the second requirement, we talked about the effect of interpretation in overturning the rights of disputes.
By the end, we talked about the effect of interpretation in overturning the rights which are related to borders.
